The apex court in a statement said it had replaced Justice Umar Ata Bandial with Justice Mazhar Alam after the latter recused himself from hearing the petitions due to ill health.
Earlier in the day, the apex court had constituted a three-member special bench to hear petition of the National Accountability Bureau (NAB) seeking reinstatement of prison term for Sharifs in Avenfield reference.
“IHC had failed to appreciate that through its order, it had seriously prejudiced the case of the prosecution by holding that the trial court judgement suffered from obvious and glaring defects and infirmities and that the convictions and sentences handed down to the accused might not be sustained ultimately,” NAB had said in its petition.
It is pertinent here to mention here that the Islamabad High Court on September 19 had annulled the jail term handed down to Sharifs by an accountability court in Avenfield reference case.
